Privacy Policy

Our commitment

Osmington Gerofsky Development Corp. and its partners, affiliates, subsidiaries and project entities ("OGDC", "we", "us") respect your privacy. This policy explains how we collect, use, disclose and otherwise process personal information when you visit our website, contact us, register your interest in a project, sign up for updates or events, apply for a job, or otherwise interact with us. We follow the Personal Information Protection and Electronic Documents Act (PIPEDA) and other applicable Canadian privacy laws.

Who is responsible

OGDC is responsible for personal information under its control. Our Privacy Officer is accountable for our compliance with this policy:

What we collect

We only collect what we need. Depending on how you interact with us, this may include:

  • Contact details you give us, such as your name, email address, phone number and mailing address
  • Information about your leasing interest, such as preferred suite type, move in timing and budget range
  • Details you include in messages, inquiries, viewing requests, event registrations, surveys, feedback forms, contests or promotions
  • Information you provide when applying for a job with us, such as your resume and cover letter
  • Information made available to us when you engage with our content on social media
  • Device information collected automatically when you visit our site, such as IP address, device identifiers, browser type, operating system and language settings
  • Usage information, such as pages visited, time spent, links and ads clicked, search terms used and whether you open our emails

We do not knowingly collect personal information from anyone under the age of majority through this website.

Why we collect it

We use personal information to:

  • Respond to your inquiries and requests
  • Share information about our projects, future leasing opportunities and events
  • Send newsletters, offers and updates, only where you have consented
  • Manage event and webinar registrations and community consultations
  • Run contests and promotions, and publish content you submit where you consent
  • Understand your needs and improve our projects, services and events through surveys and feedback
  • Engage with you on social media and understand how people interact with our content
  • Process job applications for current and future roles
  • Operate, secure and improve our website, including showing more relevant advertising as described under Cookies, pixels and advertising
  • Create anonymous or aggregated data that cannot reasonably identify you, for research, analytics and service improvements
  • Meet our legal, accounting, audit and regulatory obligations
  • Any other purpose described to you when we collect the information, or that you consent to

We may monitor and record phone calls for documentation, training and quality purposes, and we will tell you at the start of the call.

We will not use your information for a new purpose without first telling you and, where required, getting your consent.

Consent

By submitting information through our website, you consent to its collection and use as described here. You can withdraw consent at any time, subject to legal or contractual limits, by contacting our Privacy Officer or using the unsubscribe link in any email. Withdrawing consent may mean we can't provide some information or services.

Email communications

We send commercial electronic messages only with your express or implied consent, as required by Canada's Anti Spam Legislation (CASL). Every email identifies OGDC, includes our contact information and has an unsubscribe link. You can also opt out by contacting our Privacy Officer. We process unsubscribe requests within 10 business days. If you unsubscribe, you may still receive transactional messages, such as responses to your requests.

Cookies, pixels and advertising

We and third parties that provide us with analytics and advertising services use cookies, pixels (also called web beacons) and similar technologies on our website and in our emails. Cookies are small files placed on your device that let a site recognize you across visits. Pixels are small pieces of code that tell a server when you have viewed a page, ad or email, along with the time and your IP address.

We use these technologies to:

  • Make the site work and remember your preferences
  • Understand which pages and features are most used, so we can improve the site
  • Measure how well our marketing campaigns perform
  • Show you more relevant ads on our site and on other websites and platforms, known as interest based advertising
  • Detect and prevent misuse of the site

Interest based advertising and social media. Advertising partners may collect information about your visits to our site and other sites to show you ads more relevant to you. We may also provide a hashed (scrambled) version of your email address or device ID to platforms such as Meta, Google or LinkedIn so they can show our ads to you or to people with similar interests.

Analytics. We use Google Analytics to understand how visitors use our site. You can prevent Google Analytics from collecting your data by installing Google's opt out browser add on. Learn more about how Google uses data at policies.google.com/technologies/partner-sites.

Your choices. We use analytics and advertising cookies only with your consent through our cookie banner, and you can change your choices at any time. You can also block or delete cookies in your browser settings. Opting out applies only to the browser and device you use, and if you delete your cookies you may need to opt out again. To opt out of interest based ads from participating companies, visit the Digital Advertising Alliance of Canada at youradchoices.ca/choices. If you opt out, you may still see ads from us, but they will not be based on your interests. Blocking some cookies may affect how the site works.

Do not track signals. Some browsers send "do not track" signals. Because there is no accepted industry standard for responding to them, our site does not currently respond to these signals. We will revisit this if a standard is adopted.

Who we share it with

We do not sell or rent your personal information. We share it only with:

  • Service providers who help us run our business, such as our website host, email platform, CRM, analytics and advertising providers, event platforms, cloud storage, IT support and our marketing and leasing partners. They may only use your information to provide services to us and must protect it.
  • Financial institutions, auditors and advisors, where needed for accounting, financing and audit purposes
  • Our affiliates and project partners, where needed for the purposes in this policy
  • Authorities and others where required or permitted by law, such as in response to a warrant, court order or other valid legal request, to investigate a breach of an agreement or law, to detect or prevent fraud, to establish or defend legal claims, or to prevent actual or suspected loss or harm to people or property
  • A buyer, successor or financing partner, if we sell, transfer or finance all or part of our business, a project or its assets, including through a merger, acquisition, reorganization, insolvency or bankruptcy, subject to confidentiality protections
  • Anyone else with your consent, as described to you at the time

Storage outside Canada

Our website is hosted in the United States, and we and our service providers may access, store and process personal information outside Canada (and, for Quebec residents, outside Quebec), including in the United States and other countries where our service providers operate. While your information is outside Canada, it is subject to the laws of that jurisdiction and may be accessed by courts, law enforcement and government authorities there under those laws. We use contracts and other measures to require our service providers to protect your information to a standard comparable to what it would receive in Canada.

How we protect it

We use reasonable administrative, technical and physical safeguards to protect personal information in our custody or control from loss, theft and unauthorized access, use, modification or disclosure. These include defined roles and responsibilities for how our team handles personal information, and access limited to employees and authorized service providers who need it to do their jobs. We also have procedures for responding to privacy questions, requests and complaints. No method of transmission over the internet is completely secure, so we cannot guarantee absolute security.

How long we keep it

We keep personal information only as long as needed for the purposes it was collected or as required by law. When it's no longer needed, we securely delete or anonymize it.

Your rights

You can ask to see the personal information we hold about you, ask how it has been used or disclosed, and ask us to correct anything that is inaccurate or incomplete. Send your request in writing to our Privacy Officer. We will respond within 30 days, or tell you if we need more time as permitted by law. We may need to verify your identity first.

Privacy breaches

If a breach of security involving your personal information creates a real risk of significant harm, we will notify you and the Office of the Privacy Commissioner of Canada as required by law.

Changes to this policy

We may update this policy from time to time to reflect changes in our practices or the law. The updated version will be posted here with a new "Last updated" date. Depending on the nature of the change, we may also notify you in other ways, such as by email. We encourage you to review this page from time to time.
